Step 1: Probate is Opened. Someone (usually a family member) files to open probate in the county where the deceased lived. An executor or administrator is appointed.

Step 2: Assets are Identified. The executor identifies all estate assets, including real property (the house).

Step 3: Debts and Taxes. The executor pays any estate debts, taxes, and expenses from estate funds.

Step 4: Property Can Be Sold. If the will authorizes it or the court approves it, the executor can sell real property. This is where we come in.
